THE Court of Appeal of Tanzania (COA) on Monday called for the file of murder case suspect Elizabeth ‘Lulu’ Michael from the High Court.
The decision came after the prosecution was dissatisfied with a High Court’s order to investigate her age.
Giving the notice to the court on Monday, the presiding Judge, Dr Fauz Twaibu, told the prosecution to make sure that the file reached the highest court.
Lulu’s age became a subject of contention after she insisted that she is 17 years old, while the prosecution maintains that she is 18.
On June 11 this year, the High Court gave its decision saying it will investigate the actual age of Lulu which compelled the prosecution to take the matter to the Court of Appeal.
Lulu is defended by Mr Peter Kibatala, Mr Fulgence Masawe and Mr Kennedy Fungamtama whereas a commissioner at the Commission for Human Rights and Good Governance, Joaquine De-Melo, was introduced as an observer.
However, Ms De-Melo has been appointed a judge of the High Court. In the case, Lulu is charged with murdering a local movie star, Steven Kanumba, on April 7, this year at Sinza Vatican. The case was adjourned until July 23 this year for another mention.
