Another Jamii Forum director faces charge

ANOTHER Director with a famous whistle blower website, Jamii Forums, Micke William, appeared before the Kissutu Resident Magistrate’s Court in Dar es Salaam on Thursday charged with obstructing investigations conducted by the police.

William was joined in two cases before different magistrates facing his co-founder of the website, Maxence Melo.

Before Principal Resident Magistrate Thomas Simba and Resident Magistrate Godfrey Mwambapa, the accused person denied the charges.

He was granted bail until February 9, when the case comes up for preliminary hearing.

Investigations into the cases, according to the prosecution led by Senior State Attorney Mohamed Salum, have been completed.

The prosecution told the court that the accused persons committed the offences between April 1 and December 13, last year, in Mikocheni area, Kinondoni District in the city of Dar es Salaam.

It was alleged that being a director with Jamii Media Company Limited, which operates a social media website known as Jamii Forums, with intent to obstruct investigations, the accused person unlawfully failed to comply with an order of disclosure of data in their possession.

According to the prosecution, the accused person committed such offence, while knowing that the Tanzania Police Force was conducting a criminal investigation on electronic communications published on their website. Obstruction of investigations is an offence under Section 22 (2) of the Cyber Crimes Act of 2015.

The provision relates to unlawful interference with investigations and refusal to comply with an order under the Act. Section 79 of the Electronic and Postal Communications Act (2010) provides for the regulation of all electronic communication numbering and electronic addresses by the Tanzania Communications Regulatory Authority (TCRA).

Obstruction of investigations is an offence under Section 22 (2) of the Cyber Crimes Act of 2015.

Part C of the section mandates the authority to perform oversight role of management of the country’s code Top Level Domain (ccTLD).
